Service Name
This service is called BURGH FITNESS.
Operations and Management
This service is operated and managed by Rectio Estate Co., Ltd. (hereinafter referred to as "the Company"), located at 1-2-12-302 Kudankita, Chiyoda-ku, Tokyo, which is entrusted with the system operation.
Purpose
This service provides an online system for booking, payment, and timeshare usage of the facilities. Users who qualify through this system can utilize the designated facilities.
Rules
This service has specific rules for each facility. Users must adhere to these rules when using the facilities.
User Qualifications
To use this service and the facilities, users must meet all the following requirements. The Company reserves the right to refuse or suspend usage at its discretion without disclosing the reasons:
- Must be 16 years or older, understand social responsibilities, and comply with the rules.
- Must not be prohibited from exercising by a doctor or equivalent and should not have any issues using the facilities alone.
- Must handle the equipment with care, avoid deliberate damage, and promptly report any accidental damage.
- Must not be affiliated with organized crime, a drug addict, or an alcoholic.
- Must not be pregnant.
- Must not engage in activities that disturb the neighbors, such as making noise or holding gatherings inside or outside the facilities.
- Must not have been previously refused or suspended from using this service.
Usage Procedures
To use the facilities, users must agree to these terms and pay the specified price corresponding to the usage time.
Use by Minors
Minors can use the service only if both the minor and their guardian understand and comply with these terms. The guardian will share joint responsibility based on these terms.
Grant of Usage Rights
This service grants qualified users an electronic key that can be used only during the reserved time to unlock the facility. The electronic key will expire immediately after the reserved time.
Transfer of Usage Rights
Users cannot transfer any granted usage rights to others. If a transfer is discovered, the Company can revoke or suspend the usage rights.
Regarding Use by Multiple People
Users must adhere to the rules of each facility and cannot exceed the maximum number of simultaneous users. Violations may result in revocation or suspension of usage rights.
Regarding Changes to Usage Rights
Changes to usage rights are generally not allowed. Usage rights are limited to the reserved time and will expire once the time has passed.
Change of Name
This service does not allow changes to the user’s name.
Fees
The required fees, payment timing, and payment methods will be determined by the Company. Payments must be made in the specified manner regardless of usage.
Non-Refundable Fees
Paid fees will not be refunded except for special reasons deemed appropriate by the Company.
In Case of Smart Lock Malfunction
If the smart lock for the facility doors does not function properly, refunds will be issued.
Notification of Changes
Users must promptly notify the Company of any changes to the registered information in the prescribed manner.
Revocation, Suspension, and Expulsion of Usage Qualification
If the Company determines that a user meets any of the following conditions, it may revoke or suspend the user's qualification or expel them from the service. In such cases, any paid fees will not be refunded:
- Violation of these terms or the rules set by each facility.
- Damaging the reputation and credibility of the service or disrupting order.
- Deliberately damaging the facilities or equipment.
- Inability to fulfill social responsibilities when using the facilities.
- Failure to pay fees.
- Using false information to use the service.
- Determination by the Company that the user is unsuitable for the service.
- Inability to maintain the safety and health of oneself and others.
Loss of Usage Qualification
Users will lose their qualification under the following circumstances:
- When the reserved time has passed.
- Upon expulsion, suspension, or interruption.
- Death.
- If the service is closed.
Compensation for Damages
- The Company is not responsible for any damages resulting from theft, loss, injury, or other accidents occurring during the use of the service.
- Users are responsible for any damages caused to the facilities or equipment due to their actions and must compensate for such damages.
Lost, Forgotten, or Abandoned Items
The Company is not responsible for any loss of items. Abandoned items will be disposed of during maintenance and cleaning.
Revisions to User Terms and Other Rules
The Company may revise these terms, rules, and other matters related to the operation and management of the service as necessary. Revisions will apply to all users.
Closure and Dissolution
The Company may close or dissolve the service and facilities as necessary without compensating the users. This may occur due to facility renovation, maintenance, natural disasters, social conditions, or significant management reasons.
Temporary Closure and Usage Restrictions
Facilities may have scheduled holidays, maintenance days, or other unavoidable reasons for temporary closure or usage restrictions.
Entry Ban and Eviction
Users will be banned from entry or evicted for the following reasons:
- Symptoms of contagious diseases.
- Violation of these terms or facility rules.
- Non-compliance with instructions from the Company or staff.
- Health conditions that make exercise inappropriate.
- Unauthorized business activities, solicitations, commercial activities, political activities, or religious activities.
- Slandering others.
- Engaging in violence or threats.
- Indecent behavior such as molestation, voyeurism, or exposure.
- Vandalism or unauthorized construction.
- Bringing animals, except when permitted by the company.
- Bringing dangerous items
- Intoxicated behavior, alcohol consumption, or smoking within the facility.
- Stalking or similar behavior.
- Disrupting others' use of the facilities.
- Providing false information for usage.
- Disregarding the living environment of neighboring residents.
- Failure to maintain a clean environment within the facility.
Health Management
Users are responsible for managing their health at their own risk.
BURGH ID Terms of Use
Article 1 (Application of the Terms)
These terms apply to users who register for a BURGH ID issued by the Company. Users are deemed to have agreed to these terms upon using the service with a BURGH ID. Users who do not agree may unsubscribe at any time following the prescribed procedure. Notifications issued by the company to users pursuant to Article 3 shall constitute a part of these terms and conditions.
Article 2 (Changes to the Terms)
The Company may change these terms as necessary. The revised terms will be deemed accepted by users unless they unsubscribe within one week after the announcement on the BURGH site.
Article 3 (Notifications from the Company)
The Company will notify users as necessary through postings on the BURGH site, email, or other appropriate methods. If the notification in the preceding paragraph is sent by email, the notification shall be deemed complete once the email has been sent to the server of the email service registered by the user and has arrived at the server. Users are expected to promptly review the email. If the notification in the preceding paragraph is made by posting on our website, the notification shall be deemed complete once it has been posted on the site and the user can view it by accessing the site.
Article 4 (BURGH ID Users)
Users may use the services provided by the Company under the prescribed conditions. Users may not transfer their status, rights, or claims to third parties.
Article 5 (User Registration Procedures)
A BURGH ID is granted when a user completes the prescribed registration procedure and agrees to these terms. The Company may deny membership if the applicant meets any of the following conditions:
- Previous cancellation of user qualification.
- Registration with false or fictitious information.
- Any other reason deemed inappropriate by the Company.
Article 6 (Management of BURGH ID and Password)
Users are responsible for managing their registered email addresses and passwords. The Company is not liable for any damages caused by unauthorized use of a BURGH ID.
Article 7 (Changes to Registered User Information)
Users must promptly update their registered information in case of changes. The Company is not responsible for any damages caused by failure to update information. Even if a change procedure has been completed, transactions that were processed before the change registration may be conducted based on the information prior to the change registration.
Article 8 (User Unsubscription)
Users may unsubscribe at any time following the prescribed procedure on the website. Upon unsubscription, users lose all rights, benefits, and points associated with the BURGH ID.
Article 9 (Prohibited Actions)
Users are prohibited from the following actions:
- Violating these terms, additional regulations, or notices on the BURGH site.
- Engaging in illegal or criminal activities or aiding such activities.
- Damaging the rights, interests, or reputation of others or the Company.
- Engaging in activities that negatively affect the mental and physical health of minors or violate public morals.
- Disturbing or causing discomfort to others.
- Entering false information.
- Sending or writing harmful computer programs or emails.
- Unauthorized access to the Company's servers or computers.
- Any other actions deemed inappropriate by the Company.
The Company may request the submission of documents from the user to confirm whether the user's actions constitute any of the prohibited actions specified in the preceding paragraphs. In such cases, the user shall submit the documents specified by the Company. If the user refuses to submit the documents or if the Company deems the submitted documents insufficient, the Company may consider the user's actions as constituting prohibited actions.
Article 10 (Suspension or Interruption of BURGH ID)
The Company may suspend or interrupt the provision of BURGH ID without prior notice in case of system failures due to natural disasters, maintenance, or other reasons. The Company shall not be liable for any damages incurred by the user due to such interruption or suspension.
Article 11 (User Suspension and Cancellation of Qualification)
If the Company determines that the user falls under any of the following categories, the Company may cancel the BURGH ID without any prior notice or demand. The Company shall not be liable for any damages incurred by the user as a result of this cancellation.:
- Violation of laws or these terms.
- If the Company determines that the user falls under any of the circumstances specified in Articles 5 and 9.
- Engagement in fraudulent activities regarding BURGH ID use.
- Any other reason deemed inappropriate by the Company.
The user shall lose all rights to use the BURGH ID as a result of its cancellation. The Company shall not be liable for any damages incurred by the user due to this cancellation.

2.The Company is not responsible for damages caused by system interruptions, communication delays, data loss, or unauthorized access due to failures in communication lines, communication equipment, or computer systems.
3.The Company may provide information and advice to users and service providers as necessary, but shall not be held liable for any consequences arising from it.
4.The Company is not responsible for damages caused by violations of these terms.

Article 15 (Governing Law and Jurisdiction)
- In the event of any ambiguity or uncertainty regarding the interpretation of these terms, the Company shall have the authority to make a determination within a reasonable scope.
- These terms are interpreted under Japanese law. The Tokyo District Court has exclusive jurisdiction over all disputes related to these terms.
Facility Use Rules
- Clean the equipment with the provided cleaning tools after each use.
- Use the monitors at an appropriate volume to avoid disturbing others and do not watch inappropriate content. When playing videos or music on other devices, the use of equipment that leaks sound externally is prohibited. Please use headphones or similar devices.
- Do not make loud noises or engage in loud conversations.
- Eating is not allowed in the facility. Drinking non-alcoholic beverages is allowed but clean up any spills.
- Please take all trash, except for used cleaning supplies, back to your room.
- Return equipment and weight plates to their original place after use.
- Report any damage or malfunctions immediately.
- Quick lifts are prohibited. Do not drop dumbbells or barbells on the floor or handle machines roughly. Violations may result in damage compensation claims.
- Finish your workout and prepare to leave 5 minutes before your scheduled end time. Exceeding the booking time or number of users may result in additional charges.
- The Company may refuse service for inappropriate behavior.
About booking and Time Slots on the Site
On this site, a time slot is the smallest unit of time available for booking, set at a minimum of 5 minutes. A continuous sequence of time slots counts as one booking.
Example: January 1st, 10:00 - 12:00 = 1 booking
The booking start time refers to the start time of one booking.
Cancellation Policy
Users can cancel booking s from the Booking List page within their account on the BURGH FITNESS booking site. After cancellation, the amount spent on the booking will be refunded to the user's account minus the facility-specific cancellation fee.
Cancellations must be made in one booking unit.
Individual time slots within a booking cannot be canceled separately. To change specific time slots, cancel the entire booking and make a new booking with the desired time slots.
Cancellation fees are calculated based on the start time of the booking and apply to all time slots within the booking.
